Terms and Conditions
1. Scope
1.1 These terms and conditions (hereinafter referred to as "Terms") govern the contractual relationship between [Name of the Swiss online shop] (hereinafter referred to as the "Seller") and the customers (hereinafter referred to as "Customers") who purchase goods from the Seller's online shop.
1.2 These Terms apply to all orders placed by Customers through the Seller's online shop, irrespective of the customer's location.
2. Conclusion of Contract
2.1 The presentation of products in the Seller's online shop does not constitute a legally binding offer, but rather an invitation to the Customer to submit an offer.
2.2 By placing an order through the Seller's online shop, the Customer submits a binding offer to purchase the products in the shopping cart. The Seller reserves the right to accept or reject the offer.
2.3 The contract is deemed concluded when the Seller sends an order confirmation to the Customer or when the ordered products are dispatched.
3. Prices and Payment
3.1 All prices displayed in the Seller's online shop are in Swiss Francs (CHF) and include VAT.
3.2 The Customer shall bear any additional costs incurred for shipping, customs duties, and taxes, if applicable.
3.3 Payment for the ordered products shall be made by the Customer in advance, using one of the payment methods provided by the Seller.
4. Delivery
4.1 The delivery of ordered products is carried out to the address specified by the Customer during the ordering process.
4.2 The delivery times specified by the Seller are approximate and non-binding. Delays in delivery shall not entitle the Customer to cancel the contract or claim damages, unless caused by gross negligence or willful misconduct on the part of the Seller.
5. Right of Withdrawal
5.1 Customers have the right to withdraw from the contract within 14 days without giving any reason.
5.2 The withdrawal period begins on the day the Customer receives the ordered products.
5.3 For detailed information on the exercise of the right of withdrawal, please refer to the separate withdrawal policy provided by the Seller.
6. Liability
6.1 The Seller shall be liable for damages caused by intent or gross negligence.
6.2 The Seller's liability for ordinary negligence is excluded, except for damages resulting from injury to life, body, or health.
7. Applicable Law and Jurisdiction
7.1 Swiss law shall apply to these Terms and the contractual relationship between the Seller and the Customer.
7.2 The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms shall be the courts at the Seller's registered office.
8. Severability Clause
8.1 If any provision of these Terms is or becomes invalid, ineffective, or unenforceable, the validity, effectiveness, or enforceability of the remaining provisions shall not be affected. The invalid, ineffective, or unenforceable provision shall be replaced by a valid, effective, and enforceable provision that comes closest to the economic purpose intended by the parties.
